These terms govern your use of the Kenworth Ontario website at kenworthontario.com (the “Site”). By using the Site you agree to them. If you do not agree, please do not use the Site.
1. Who we are
The Site is operated by Kenworth Ontario, a Kenworth truck dealer with branches in Ottawa, Kingston, Peterborough, Thunder Bay and Belleville, Ontario.
2. Use of the Site
You may use the Site to learn about our trucks, parts and services, to contact us, to book service, to order parts, to enquire about financing and to apply for employment. You agree not to use the Site to interfere with its operation or security, to submit false information, to attempt unauthorised access, or to scrape or republish its content for commercial purposes without our written permission.
3. Truck inventory, parts and pricing
Inventory listings, specifications, availability and prices on the Site are for information only. They are not an offer to sell and do not form a contract. Inventory changes continually and listings may be out of date, incomplete or contain errors. Specifications are provided by the manufacturer or taken from the unit and may vary from the actual vehicle. A sale is only agreed in writing with one of our branches. Errors and omissions excepted.
4. Information you send us
When you submit a form on the Site, the information you provide is handled as described in our Privacy Policy. Please do not send us confidential, financial or sensitive personal information through a web form beyond what the form asks for. Submitting a form does not create a professional, agency or confidential relationship between you and Kenworth Ontario.
5. Employment applications
Résumés and application details submitted through our Careers pages are used to assess you for the role you applied for and for other roles we think may suit you. They are sent to our HR team by email. Submitting an application does not create an offer of employment or any obligation on us to respond.
6. Intellectual property
The text, layout, graphics and photographs on the Site are owned by Kenworth Ontario or used with permission, except where stated. “Kenworth”, the Kenworth bug logo, “PACCAR”, “PremierCare” and related marks and model names are the property of PACCAR Inc. and its affiliates and are used here to describe the products we sell and service. Nothing on the Site grants you a licence to use any of these marks.
7. Third-party links and services
The Site links to third-party sites and services, including the Kenworth parts counter, online mapping and manufacturer resources. We do not control those sites and are not responsible for their content, availability or privacy practices. Following such a link is at your own risk.
8. Availability
We aim to keep the Site available and accurate but do not guarantee uninterrupted or error-free operation, and we may change or withdraw any part of it at any time without notice.
9. Disclaimer and limitation of liability
The Site is provided on an “as is” and “as available” basis. We take care to keep it accurate and current, but we do not warrant that the information on it is complete, accurate or up to date, or that the Site will be uninterrupted or error free.
In particular, truck listings, specifications, parts availability, pricing, promotions and branch hours shown on the Site are for general information. To the fullest extent permitted by law, Kenworth Ontario is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or business, arising out of your use of the Site or your reliance on anything published on it. Where liability cannot lawfully be excluded, it is limited to the amount you have paid us, if anything, in respect of the matter giving rise to the claim.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of Ontario or under applicable consumer protection legislation. If you are a consumer, your statutory rights are not affected.
The Site may link to or rely on services operated by others. We are not responsible for the content, availability or practices of those services.
